Welcome to Se Mexa! These Terms of Use ("Terms") govern access to and use of the Se Mexa application ("Service"), developed and operated by StartFlow ("Company," "we," "our," or "us").

By creating an account, accessing, or using Se Mexa, you declare that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

Se Mexa is a health and fitness application that provides:

  • Personalized workout programs assisted by Artificial Intelligence (AI)
  • Real-time GPS activity tracking
  • Daily step counting via pedometer
  • Nutritional analysis by text and photography (via AI using Google Gemini Vision)
  • AI-generated weekly meal plans
  • Habit tracking, weekly and quarterly goals powered by AI
  • Global physical activity ranking
  • Social community (posts, comments, friendships)
  • Optional Strava integration
  • Exclusive programs from gym partners (B2B model)
  • Exercise library with demonstration videos (MuscleWiki)

2. Eligibility

To use Se Mexa, you must be 16 years of age or older. By using the Service, you declare that you meet this requirement. Users between 16 and 18 years of age declare that they have the consent of their legal guardian.

The Service is primarily aimed at users in Brazil but is available internationally.

3. Account Creation and Security

To access most features, you must create an account with your full name, email, and password. You are responsible for:

  • Maintaining the confidentiality of your access credentials
  • All activities performed under your account
  • Promptly notifying us of any unauthorized use at sstartflow@gmail.com

You must provide truthful information and keep your data up to date. Creating multiple accounts to circumvent plan restrictions or trial periods is prohibited.

4. Plans, Subscriptions, and Payments

Se Mexa offers three access tiers:

  • Free: Basic workout and health monitoring features, at no cost and with no time limit.
  • Start: Access to nutrition, community, directed workout programs, and full history. Requires a paid subscription.
  • Pro: Full access to all features, including advanced AI, custom workout builder, camera-based food analysis, smart tracking, quarterly goals, and priority support. Requires a paid subscription.

How to subscribe: Subscriptions are purchased exclusively via the official website (semexa.app) or gym partners. The app does not process payments and does not use Apple In-App Purchase or Google Play Billing.

Trial period: New users may receive temporary free access to paid plans. When the trial ends, access reverts to the free plan with no automatic charge.

Gym Partners (B2B): Gym partner members activate their accounts via CPF (Brazilian tax ID). B2B plan access is tied to an active gym enrollment. Cancelling the gym membership may result in the loss of premium features linked to the gym's plan.

5. Acceptable Use

By using Se Mexa, you agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Create fake accounts or impersonate another person
  • Post offensive, discriminatory, pornographic, violent content, or content that violates third-party rights in the community
  • Attempt to access other users' data without authorization
  • Reverse-engineer, decompile, or attempt to extract the app's source code
  • Use bots, scripts, or automated tools to interact with the Service
  • Intentionally interfere with the Service's infrastructure or overload our servers
  • Post false or misleading health information that could lead others to harmful practices
  • Share, sell, or transfer your account to third parties

6. Artificial Intelligence — Use, Limitations, and Consent

Several Se Mexa features are powered by Artificial Intelligence, including:

  • Food photo nutritional analysis (via Google Gemini Vision AI)
  • Personalized workout programs
  • Weekly meal plans
  • Smart weekly and quarterly goals
  • Smart Tracking widget with daily suggestions

⚠️ Important limitation: AI-generated analyses and recommendations are estimates and suggestions of an informational nature. Results may not accurately reflect the exact nutritional content of foods nor constitute an ideal exercise or diet program for your specific condition. Results vary from person to person and are not guaranteed.

When using AI features that involve sending data to third parties (such as photo analysis), the app will display a consent screen explaining which data is sent, to whom, and for what purpose. Your acceptance is required before any data is sent.

7. Medical and Health Disclaimer

Se Mexa is not a medical service and does not replace consultation with qualified healthcare professionals.

  • The app's content is informational and educational in nature and does not constitute medical, dietary, or fitness prescription.
  • Before starting any exercise program or dietary change, especially if you have pre-existing health conditions, consult a physician, nutritionist, or certified fitness professional.
  • If you experience pain, discomfort, or illness during exercise, stop immediately and seek medical assistance.
  • Calorie and macronutrient estimates are approximations and should not be used as the sole basis for dietary decisions, especially for conditions such as diabetes, eating disorders, or other clinical conditions.
  • StartFlow is not responsible for health decisions made based solely on the app's AI-generated recommendations.

8. Community Content

Se Mexa has a social area where users can post content (text, photos, achievements) and interact with other users. When posting content:

  • You are solely responsible for the content you post.
  • You grant us a non-exclusive, royalty-free license, valid during the publication period, to display that content to other app users.
  • We reserve the right to remove without prior notice any content that violates these Terms, our Privacy Policy, or that we deem inappropriate.
  • Posted content is visible to other app users. Do not share sensitive personal information (identity documents, financial data, identifiable medical information) in your posts.
  • Content that violates these Terms may result in account suspension or termination.

9. Strava Integration

The Strava integration is entirely optional and requires your explicit authorization. By connecting your Strava account to Se Mexa:

  • You authorize Se Mexa to access activity and profile data as described in our Privacy Policy.
  • The use of Strava data is subject to Strava's Terms of Service.
  • You can disconnect the integration at any time from within the app.

10. Intellectual Property

All app content, including design, interface, text, icons, logos, source code, algorithms, and exercise materials (except third-party content such as MuscleWiki videos), is the exclusive property of StartFlow or its licensors and is protected by copyright and intellectual property laws.

Reproduction, redistribution, modification, creation of derivative works, or commercial use of any part of the Service without prior written authorization from StartFlow is expressly prohibited.

The name "Se Mexa," the app logo, and associated marks are trademarks of StartFlow. Unauthorized use of these marks is prohibited.

11. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms. This includes, in particular, health data (weight, height, medical restrictions), GPS location data, and food photos sent to Google Gemini Vision AI — all with purposes and safeguards detailed in the Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by applicable law, StartFlow shall not be liable for:

  • Indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Service
  • Physical, muscular, or joint injuries resulting from exercise based on the app's recommendations
  • Inaccuracies in AI-generated nutritional analyses
  • Temporary interruptions to the Service due to technical issues, maintenance, or force majeure
  • Actions, omissions, or policies of third parties integrated into the app (Strava, Google Gemini, MuscleWiki, Expo)
  • Data loss due to technical failure unrelated to StartFlow's gross negligence

Our total liability to you in any case is limited to the amount you paid for the services in the preceding 3 months (or USD 10.00, whichever is greater).

13. Indemnification

You agree to indemnify, defend, and hold harmless StartFlow, its partners, employees, contractors, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) violation of these Terms; (c) violation of third-party rights; or (d) content you post on the Service.

14. Termination

You may close your account at any time through the app (Profile → Log out → Delete Account) or by contacting us at sstartflow@gmail.com.

We may suspend or terminate your access immediately, without prior notice, if you violate these Terms, with email notification when possible. Following termination for violation, no refunds will be issued for amounts already paid.

After any account termination, your data will be handled in accordance with our Privacy Policy.

15. Modifications to These Terms

We may update these Terms at any time. Material changes will be communicated at least 15 days in advance through the app or by email. Continued use of the Service after this period constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account before they take effect.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federative Republic of Brazil, including the Brazilian Civil Code, Consumer Protection Code (Law No. 8,078/1990), and the General Data Protection Law (Law No. 13,709/2018).

The parties shall first attempt to resolve any disputes in good faith through direct negotiation before resorting to legal proceedings. For users outside Brazil, nothing in these Terms limits your rights under the applicable consumer protection laws of your jurisdiction.

17. General Provisions

  • These Terms constitute the entire agreement between you and StartFlow regarding use of the Service.
  • If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force.
  • StartFlow's failure to exercise any right provided in these Terms does not constitute a waiver of that right.
